This page sets out the terms and conditions clients must agree to when working with BespokeBookCovers.com. They are designed to make the process of working together fair and reasonable for both designer and client.
CONFIDENTIALITY
All the information that clients share with us is considered confidential, and will only be used by BespokeBookCovers.com to provide a quote for our services, or to complete a book cover design project. We will not share this information with any third party, unless requested to do so by our client. We do not liaise with third parties (such as printers, publishers or editors) on behalf of our clients, and request that clients do not pass on our details or email addresses on to any third parties.
RIGHTS OF OWNERSHIP
When the balance payment is received, BespokeBookCovers.com will grant the client exclusive license for the final cover design. We will provide the design in PDF, JPEG or another publishing-ready format as requested. The client agrees that they have no right to alter the completed design in any way. We will not provide the client with fonts or source files.
IMAGE USAGE
The client must abide by the terms of the license agreement for the images used in the cover design, which have been purchased by BespokeBookCovers.com for use on the design. The cost of your cover design includes the rights to use the complete book cover as a whole, to a print-run of 500,000 units, or sales in the case of ebooks. If necessary, this 500,000 limit can be extended, for an additional cost. It is the client’s responsibility to inform BespokeBookCovers.com if this is the case.
CLIENT RESPONSIBILITIES
Clients are advised to allow a reasonable time-frame between commissioning a cover design and their proposed publication date to allow for the appropriate work to be produced. BespokeBookCovers.com takes no responsibility for any costs incurred by the client as a result of delays to publishing dates, and all dates quoted are approximate and may vary due to the nature of the creative process. It is the client’s responsibility to order a proof copy of their cover design from their printer before putting their book on sale. In the case of any problems or expenses incurred by the client in relation to using the cover design, BespokeBookCovers.com will take no financial or legal responsibility for this. The client must provide an actual size template from their printer or publisher, which the final design can be fitted to, in order for BespokeBookCovers.com to produce the print-ready file. Cost quoted for our services do not include the production of final printing templates. BespokeBookCovers.com may be able to produce such templates in exceptional circumstances, only with prior agreement, and for an additional charge.
LIABILITY
BespokeBookCovers.com is not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including loss of revenues or profits, loss of business or reputation, or loss of data, in any way related to our services. We are not liable for any breach of our obligations resulting from causes beyond our reasonable control including strikes of our own employees, natural disasters or political unrest. BespokeBookCovers.com is not responsible for any claim, loss, or injury based on errors or any other inaccuracies appearing on our site or in our clients’ written documents, including without limitation as a result of any breach of the terms and conditions of this agreement.
PAYMENT
The client agrees to pay a 50% deposit upfront in order to have their project scheduled in for work to start. The balance is payable when the client is 100% happy with their design. Once final payment has been received, BespokeBookCovers.com regards this as final approval of the overall design, and the contract to be fulfilled. BespokeBookCovers.com agrees to make amendments to layout and text only after this time BespokeBookCovers.com will continue to make changes to the design at no extra charge for 1 year after the start date quoted to the client. After this time, BespokeBookCovers.com reserves the right to request payment for any requested changes. Either the client or BespokeBookCovers.com may cancel a project before the start date by providing written notice to the other, and will be under no further obligation to the other party. If, after the initial deposit has been paid, and work has started on the design, the client chooses to end the project, they agree to forfeit the deposit already paid. This is to cover costs and time already incurred by BespokeBookCovers.com. If BespokeBookCovers.com ends the project, they will refund the deposit already paid.
